Often when borrowing money, the lender may seek a personal guarantee from a third party in the event of default by the borrower. These people are called guarantors. Guarantors agree to repay a debt another person incurred if that person fails to meet the terms of the guarantee. If the person goes bankrupt or cant pay their debts, the creditor will seek to recover what is owed from the guarantor. Professional advice should be sought as to the risks and implications of any default on the guarantor.
From time to time, disputes may arise between neighbours. These generally relate to fences or problem trees encroaching on boundaries or sunlight, views etc, or car parking or noise but can be over anything which causes disturbance to one or other of the parties. Neighbour disputes are best resolved by negotiation and mediation but sometimes it is necessary to get an independent arbitrator or the Court to listen to both sides and decide a course of resolution.
The Law Store can assist with disputes between neighbours because we are independent. We can be called in to listen to both sides objectively. We can also engage arbitration services from outside specialists in this field.
Fencing and tree issues:
Council bylaws or regulations and housing covenants often have rules and restrictions about fencing and trees. In the event of disputes, The Law Store can assist to facilitate resolution or deal with the regulatory authority to try to find an equitable solution using effective dispute resolution practices.
