Partners separating custody and access to children
 
When partners with children separate there are up to three things that need to be sorted;
 
1.      Who is going to look after the children?
2.      Who is going to have access to the children?
3.      How any property is to be split up?

 
As from 1 June 2005 the law relating to care of children was changed.  Custody orders, access orders and guardianship orders are all now called Parenting Orders if made by the Family Court or Parenting Agreements where both partners can agree. The lawyers at The Law Store can prepare parenting agreements and apply to the Family Court for parenting orders.

Violence in the home protection orders  
 
The law says that domestic violence is:
 
Physical abuse, sexual abuse and psychological abuse (e.g. intimidation, harassment, damage to property and threats) against a person by any other person who is or has been in a domestic relationship with that person.
